MSW Secures Complete Summary Judgment Victory in Contentious Newark Real Property Dispute

Murphy Schiller & Wilkes LLP (MSW) is pleased to announce that its Commercial Litigation team achieved a decisive victory on behalf of its client, obtaining a full grant of summary judgment in a highly contested real estate dispute in Newark, New Jersey.

In a comprehensive ruling, the court determined that MSW’s client qualified as a bona fide purchaser for value, rejecting the plaintiff’s claims for specific performance in their entirety. The court further upheld our client’s rights with respect to the property and confirmed its designation as the duly authorized redeveloper, bringing finality to a contentious and high-stakes dispute.

This successful outcome reflects the team’s strategic approach and deep experience navigating complex real property and redevelopment matters, particularly those involving competing equitable claims and redevelopment designations.

The matter was handled by Brant Forrest, Partner and Co-Chair of the firm’s Litigation practice, and Jacqueline Candella, an associate in the Litigation practice.

Newark, N.J. — April 1, 2026 — Murphy Schiller & Wilkes LLP (MSW) is pleased to announce that, effective April 1, 2026, Robert M. Lyons has been elevated from associate to counsel.

Robert is a member of the firm’s Construction Law and Litigation practice groups, where he represents developers, owners, contractors, subcontractors, construction managers, architects, engineers, and surveyors in a broad range of disputes arising from complex commercial real estate and construction projects. His practice includes representation in matters involving contract disputes, delay and impact claims, defective construction, design negligence, and related shareholder disputes in both state and federal courts.

Prior to joining MSW, Mr. Lyons practiced at a national litigation firm in New York City. He earned his Juris Doctor from Fordham University School of Law and his undergraduate degrees from Providence College, where he received a B.A. in Economics and a B.S. in Finance, cum laude. He is admitted to practice in New Jersey and New York, as well as the U.S. District Court for the District of New Jersey.
