Anthony Capasso

Anthony D. Capasso is a partner and co-chair of the Construction Law and Litigation practice groups, where he focuses on complex commercial litigation with an emphasis on construction and real estate disputes.

For over twenty years, Anthony has zealously represented every player in the built environment, including architects and engineers, owners/developers, contractors, and trade subcontractors. He brings to each client a unique set of problem-solving skills forged by a multidisciplinary civilian and legal background, including working in construction, as a law clerk for the court, as an attorney with both a large Manhattan construction litigation firm and a mid-size New Jersey firm, and as a claims professional for an international insurance company. Moreover, Mr. Capasso has been recognized as a fellow of both the Construction Law Society of America and the Trial Law Institute, and as a member of the American Institute of Architects.

Mr. Capasso represents design professionals (including architects, civil engineers, structural engineers, geotechnical engineers, and mechanical engineers), owners, construction managers, general contractors, prime and trade contractors, and joint ventures, in litigation, construction transactions, and construction project and risk management situations.

Specifically, Mr. Capasso’s litigation practice focuses on high exposure construction-related matters involving professional liability errors and omissions, including ADA and FHA Claims (Department of Justice), construction defect, catastrophic construction property damage, construction site accidents, and contract disputes. He also counsels clients on mitigating damages during active construction projects with an eye bent toward litigation. Mr. Capasso specializes in defending catastrophic building subsidence matters and related issues including structural member failure and geotechnical issues including soil densification and liquefaction.

Mr. Capasso’s construction law practice includes contract negotiation, drafting, and review, along with advising clients on project planning and management, claim preparation, change orders, and equitable adjustments. He is thoroughly familiar with all construction delivery methods, including design-bid-build, design-build, and construction management. He works with his clients on a full range of public and private sector construction projects, including residential, commercial, infrastructure, industrial, and mixed-use.

Anthony splits his time between homes in Randolph NJ and Long Branch NJ, with his wife Holly, daughters Olivia and Sophia, son Logan, and canines Duke and Maverick. Anthony is an avid outdoorsman, with emphasis on big game bowhunting and saltwater fishing. He also has affinities with cigars, classical and 20th Century poetry and literature, combat sports, weightlifting, heavy metal and outlaw country music.
