R. Brant Forrest

R. Brant Forrest is a partner and co-chair of the Construction Law and Litigation practice groups. Brant represents developers, owners, contractors, subcontractors, construction managers, architects, engineers, and surveyors across a wide array of matters in the real estate development and construction industry. Brant has assisted clients on major projects across the country including residential developments, high-rise buildings, airports, hospitals, education facilities, stadiums, hotels, water and sewer treatment plants, power plants, pipelines, and highways.

Brant counsels and assists developers, owners, construction managers, contractors, and design professionals with negotiation and preparation of development agreements, construction contracts, design-build contracts, construction management agreements, material and supply agreements, purchase and sale contracts, bid documents, credit agreements, partnership agreement, joint venture agreements, and operating agreements. Brant draws on his diverse background in the construction and real estate industry and familiarity with standard industry forms, such as the American Institute of Architects, to uniquely tailor each agreement to his client’s needs and manage the risk inherent in every construction project.

Brant also works with owners, developers, contractors, and design professionals in contract administration, project management, and claims management during the lifecycle of construction projects. He has specific experience with claims and disputes on public and private projects involving equitable adjustments, change orders, extra work claims, differing site conditions, schedule extensions, insurance claims, force majeure events, and termination.

Brant’s litigation experience includes contract disputes, delay claims, defective construction claims, design negligence, lien foreclosure and discharge actions, bid protests, payment and performance bond claims, shareholder disputes, and CERCLA and New Jersey Spill Act claims. Brant has represented clients in state and federal courts throughout New Jersey and New York, in addition to mediations and arbitrations across the country.

Brant began his legal career as a judicial law clerk for the Honorable Frank M. Ciuffani, P.J. Ch. (Ret.), Middlesex County, Chancery Division. Brant received his bachelor’s degree from Pennsylvania State University and law degree from Seton Hall University School of Law.
