David A. Roth

COUNSEL

David A. Roth brings more than 25 years of experience advising companies, developers, investors, and individuals on the full spectrum of complex environmental, health, and safety matters. As Counsel in MSW’s Environmental Law practice, David is a trusted resource for clients navigating federal and state regulatory frameworks, compliance obligations, and enforcement actions. His work spans major environmental statutes, including New Jersey’s Industrial Site Recovery Act (ISRA) and Site Remediation Reform Act (SRRA), the Resource Conservation and Recovery Act (RCRA), the Clean Water Act, the Toxic Substances Control Act (TSCA), the Occupational Safety and Health Act (OSHA), and various Right‑to‑Know laws.

David has extensive experience counseling clients involved in brownfields redevelopment and other site investigation and remediation projects. He collaborates closely with environmental consultants and technical experts to develop cost‑effective, practical strategies for meeting the New Jersey Department of Environmental Protection’s Technical Requirements for Site Remediation (TRSR), Administrative Requirements for the Remediation of Contaminated Sites (ARRCS), and the Licensed Site Remediation Professional (LSRP) program.

His practice also includes advising on the environmental components of business transactions, including real estate acquisitions and dispositions, leasing, mergers and acquisitions, and financing. David assists clients with environmental due diligence, liability allocation, contract negotiation, and the structuring of post‑closing remediation, engineering and institutional controls, land use restrictions, operation and maintenance obligations, and long‑term reporting requirements.

David represents owners, operators, generators, and other potentially responsible parties (PRPs) in private and governmental litigation, cost allocation proceedings, and other disputes arising under the federal Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA/Superfund), New Jersey’s Spill Compensation and Control Act (Spill Act), and analogous state superfund laws. His work spans hazardous waste disposal and contamination sites across the United States.

David earned his J.D. from the University of Maryland School of Law and his B.S. from Rutgers University. He is admitted to practice in New Jersey and Maryland.
